The Court Turns Down China's First Same-Sex Marriage Safeguard Lawsuit

On April 13, 2016, China's first same-sex marriage safeguard lawsuit was in court in Changsha, Hunan.

According to China News, on June 23, 2015,Sun Wenqing and his gay partner Mr. Hu went to the city's civil affairs bureau but the official rejected their application to register the marriage by informing that "only a man and a woman are allowed to get married".

Later Sun decided to fight back then he and his lawyer submitted a complaint to the local court.

Sun holds that the concept of "monogamy " in Marriage Law of PRC differs from "a man and a woman". The previous one is set to object polygamy or polyandry while the latter relates to gender. Based on this, he thinks the sued official comprehended the law falsely.

For this, the court has rejected his lawsuit, holding that the marriage law makes a clear rule of the subjects of legal marriage as man and woman.

Sun says he will continue to appeal.
